On Micromax Plea - Delhi Court's Temporary Injunction on OnePlus Sales

The misfortune for the Chinese mobile manufacturer, OnePlus is not taking a pause for a once from the day one, when it decided to bring its smartphone in India. After ditching OnePlus’ Cyanogen support in India, the Company has now ordered by High Court to put a temporary stop on selling its ‘One’ smartphone in Indian market. The homegrown tech giant Micromax Informatics Ltd has filed a case against the Chinese mobile maker to infringe its exclusive rights for making CyanogenMod based phones.

It seems like the time for the OnePlus is quite woeful. First the US-based software developing company Cyanogen ditched to support its devices anymore in India. Then, the same Company has partnered with Micromax to work exclusively with them only for its Yu series devices. Now, this temporary injunction for selling and shipping its smartphones has appeared as another hiccup.

High Court has ordered the Chinese gargantuan for not to sell, market and ship its smartphones, if they are engraved with Cyanogen logo. This will be apt for the OnePlus’ devices since the Micromax-Cyanogen partnership. Justice Manmohan Singh though has allowed the giant to end its stock of One handset, which it had launched on December 2 through Amazon India.

OnePlus Banned in India

After obtaining "ambient services and application distributions agreement", the Micromax has the only rights to incorporate and use the Cyanogen’s technology in its devices. However, the OnePlus had already announced earlier that they are working on its own custom Android build and will also not receive any Cyanogen update in India. It is said that, Micromax has taken this step to protect its exclusivity because it’s launching YU Cyanogen phone on Thursday.

OnePlus is not the one Company who is suffering this setback, one more Chinese tech giant Xiaomi had already went through this and banned to sell, market an import its devices on subject of Patent infringement. However, Delhi High Court then allowed them to sell selected devices.
