Supreme Court Takes Down Trai Decision for Telecoms to Pay for Call Drops

The Supreme Court on Wednesday issued another notice taking down the Trai directives for the telecom organizations to compensate their valuable customers for the unwanted call drops holding it as "arbitrary, absurd and non-transparent".

In their official statements justice, Kurian Joseph and R F Narain stated: "We have held the conflicting regulation to be ultra vires, arbitrary, unreasonable and non-transparent." The apex court had passed the judgment on the claims that were presented by the COAI, a separate body of Unified Telecom Service Providers of India and 21 telecom operators that included Vodafone, Bharti Airtel and Reliance, that also directly challenged the Delhi High Court order which had stuck with Trai's decision and made it mandatory for telecom operators to remunerate subscribers for call drops from this January.

Delhi High Court issues notice to TRAI

The telecom organizations had before told the apex court that the whole sector is under huge debt and hence they are forced to pay a huge cost for the entire spectrum range, and hence considering the same factor, zero tolerance on call drops ought not to be forced on them.

Trai also alleged the telecom operators of earning huge bucks in the sector, however, the companies had some other story to entail as they stated that though they do earn some gains, but to compensate the gains they also invest hugely in the infrastructure. The Telecom Regulatory Authority of India (Trai) had prior told the apex court that it will make a move against the Telcos for call drops to secure the interests of its customers as these service providers are not willing to compensate their users willingly.

The administrative body had advised the court that it needs to shield 100 crore telecom supporters and if organizations consent to repay call drops with an equivalent number of free calls to purchasers without pre-conditions then it is interested in re-consider its bearing forcing a punishment on them.

Telecoms need to improve their services to remove call drops

It had additionally told the court that a "group" of 4-5 telecom firms having a billion supporters nearly make Rs. 250 crores a day however they do not take necessary steps required for the improvement of their services and system alike to check unwanted call drops.

Even the counsel for telecom operators had vehemently refused the allegations of Trai that telecom organizations are not contributing on improving their technology and in its defense had stated that in the past 15 months more than two lakh towers have been installed. The Delhi High Court had early this year maintained October 16, 2015, choice of Trai, making it compulsory for cell administrators to pay buyers one rupee for every call drop experienced on their systems, subject to a top of Rs. 3 a day.
